Intellectual Property Dispute Resolution Policy

1. Mechanism for Notification of Intellectual Property Disputes

Onside is committed to protecting intellectual property rights on the Onside Store in the United States and provides a mechanism for rights holders, developers, and other affected parties to report suspected infringement. Notices may be sent by email to legal@onside.io or by mail to Onside.io Inc., 1712 Pioneer Ave Ste 500, Cheyenne, Wyoming, US 82001-4406. Notices alleging copyright infringement should be directed to Onside's designated DMCA agent, identified in Section 7 below, in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

2. Required Information for Intellectual Property Notifications

To be processed, a notification should include:

  • identification of the intellectual property right allegedly infringed (for copyright claims, identification of the copyrighted work claimed to have been infringed);

  • identification of the material claimed to be infringing, and information reasonably sufficient for Onside to locate it on the Onside Store;

  • the complainant's contact information, including name, address, telephone number, and email address;

  • a statement that the complainant has a good-faith belief that use of the material is not authorized by the rights holder, its agent, or the law; and

  • a statement, made under penalty of perjury for copyright notices, that the information in the notification is accurate and that the complainant is the rights holder or authorized to act on the rights holder's behalf, together with a physical or electronic signature.

Incomplete notifications may result in delayed processing or rejection.

3. Handling of Intellectual Property Disputes

Upon receiving a complete notification, Onside will acknowledge receipt, evaluate the claim, and, where appropriate, notify the affected developer of the claim to give the developer an opportunity to respond, before determining what action to take.

4. Removal or Disabling of Infringing Content

Where infringement is confirmed, Onside will take action proportionate to the violation, which may include temporarily disabling access to the app pending review, removing the infringing app or content, or suspending future updates to the app.

5. Counter-Notifications and Developer Response

A developer whose app has been removed or disabled in response to a notification may submit a counter-notification if the developer believes the material was removed as a result of mistake or misidentification. A counter-notification should include:

  • identification of the material that was removed or disabled and its location before removal;

  • a statement, under penalty of perjury, that the developer has a good-faith belief the material was removed or disabled as a result of mistake or misidentification;

  • the developer's name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for the developer's address (or, if outside the United States, for any judicial district in which Onside may be found), and that the developer will accept service of process from the original complainant; and

  • the developer's physical or electronic signature.

Where required by the DMCA, Onside will forward a valid counter-notification to the original complainant and, absent the complainant filing a court action seeking to restrain the developer within the statutory period, may restore the material.

6. Repeat Infringers

Onside maintains a policy of, in appropriate circumstances, terminating the accounts of developers who are found to be repeat infringers. Developers with multiple confirmed violations may face escalating consequences, including formal warnings, enhanced review of future submissions, account suspension, and permanent removal from the Onside Store.

7. Designated DMCA Agent / Contact Information

Notices and counter-notices under this policy may be sent to:

Designated Agent: Licensed DMCA Agent Onside.io Inc. 1712 Pioneer Ave Ste 500, Cheyenne, Wyoming, US 82001-4406 Email: legal@onside.io

8. Acknowledgment

By using the Onside Store, developers and users acknowledge and agree to this Intellectual Property Dispute Resolution Policy.
