# Onside Terms of Use

Applicable to users accessing the Services from the United States Effective Date: September 10, 2026

## 1. Your Relationship With Onside.io Inc.

These United States Terms of Use ("Terms") govern your access to and use of the Onside Store — an alternative third-party marketplace for Android applications — together with related websites and associated services (collectively, the "Services") made available by Onside.io Inc., a company registered in Wyoming with its registered office at 1712 Pioneer Ave Ste 500, Cheyenne, Wyoming, US 82001-4406 ("Onside," "we," "us," or "our"). Onside.io Inc. is affiliated with Onside.io BV, which operates the Onside Store for users outside the United States.

These Terms apply specifically to users who access or use the Services from the United States. Onside publishes separate terms of use at onside.io for users located in other countries; if you access the Services from outside the United States, those other terms may apply to you instead.

You are bound by these Terms unless you and Onside have signed a separate written agreement that expressly supersedes them. Certain Services, features, promotions, or Content (defined below) may be subject to additional terms and conditions ("Additional Terms"). Additional Terms are incorporated into these Terms by reference and apply to your use of the relevant Service or feature. In the event of a conflict between these Terms and any Additional Terms, the Additional Terms control with respect to that specific Service or feature.

## 2. Acceptance of the Terms; Eligibility

You accept these Terms by (a) clicking "I agree," "I accept," or a similar button where presented, or (b) accessing, downloading, installing, or otherwise using any part of the Services. If you do not agree to these Terms, you must not access or use the Services.

You may use the Services only if you are able to form a legally binding contract with Onside, and only if you are not a person barred from receiving the Services under the laws of the United States or any other applicable jurisdiction (including export control, sanctions, or anti-money-laundering laws). If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.

Children's privacy. The Services are not directed to, and are not intended for use by, children under the age of 13, and Onside does not knowingly collect personal information from children under 13 except as permitted by the Children's Online Privacy Protection Act ("COPPA"). If you are between 13 and the age of majority in your state of residence, you may use the Services only with the involvement, knowledge, and consent of a parent or legal guardian, who must agree to these Terms on your behalf and is responsible for your use of the Services. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take reasonable steps to delete that information. A parent or guardian who believes their child has provided us with personal information without consent may contact us at <support@onside.io>.

## 3. Language

These Terms are written in English. Onside may, at its discretion, make translated versions available for your convenience. If there is any conflict or inconsistency between the English version of these Terms and a translated version, the English version governs and controls.

## 4. Delivery of the Services

The Onside Store is an alternative Android application marketplace: a store app that you download directly from onside.io as an installation package ("APK") and install on your Android device independently of the Google Play Store. To install the Onside Store, you may need to change your device settings to allow installation of apps from sources other than Google Play (sometimes described as "sideloading" or allowing installs from "unknown sources").

You are solely responsible for deciding whether to enable this setting, for evaluating any security or warranty implications under your device manufacturer's or carrier's policies, and for confirming that your device and Android version support the Onside Store. Onside is not responsible for changes made by Google, device manufacturers, carriers, or Android operating system updates that affect your ability to install, access, or use the Services.

Once installed, the Onside Store lets you create an account; browse a catalog of apps and games (with a current focus on casual games) published by third-party developers ("Developers"); and download, install, update, and purchase such apps and related in-app digital content ("Content") directly through the Onside Store, in the same way you would through any other app marketplace. A single Onside account may allow access across the Onside Store, related websites, and associated tools.

Onside may add, modify, suspend, or discontinue any part of the Services (including individual apps or Content) at any time; impose limits on storage, bandwidth, or usage; and cause the Onside Store or individual apps to update automatically. Except where applicable law requires otherwise, Onside may do any of the foregoing without prior notice and without liability to you.

## 5. Account Security and Password Management

If you create an account, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not you authorized that activity. You agree to notify Onside immediately at <support@onside.io> of any unauthorized use of your account or any other breach of security. Onside is not liable for any loss or damage arising from your failure to safeguard your credentials.

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.

## 6. Purchases of Apps and In-App Content

Prices for apps and Content are set by the applicable Developer, may include sales tax as required by the laws of the U.S. state (and any local jurisdiction) in which you are located, and are subject to change without notice for future purchases.

Depending on the Developer, the contract for your purchase of Content is formed either (a) directly between you and Onside, or (b) directly between you and the Developer, with Onside acting as the Developer's commercial and payment agent for purposes of processing the transaction and collecting payment on the Developer's behalf. In either case, Onside is responsible for processing your payment and for customer support relating to the transaction as described in these Terms.

Payment. You must provide accurate, current payment information, and you authorize Onside and its third-party payment processor(s) to charge your chosen payment method for all purchases (including applicable taxes) that you make or authorize through the Services.

Digital content is generally delivered or made available to you immediately upon confirmation of your purchase. Because of the nature of digital content, once a purchase has been delivered, you acknowledge that you may not be entitled to a refund except (a) where required by applicable law, (b) as expressly stated in Onside's refund policy (available at onside.io or on request from <support@onside.io>), or (c) where Onside, in its discretion, agrees to issue a refund. If you believe a transaction on your account was unauthorized or fraudulent, contact <support@onside.io> promptly so Onside can investigate.

## 7. Your Use of the Services

You may use the Services only in compliance with these Terms and all applicable laws. You may not distribute, resell, or make the Services available to third parties except as expressly permitted under a separate written agreement with Onside.

You may not use bots, scrapers, crawlers, or other automated means to access the Services except as expressly permitted by Onside in writing or by the robots.txt file or similar technical mechanism made available for that purpose. You are responsible for any breach of these Terms caused by your use of the Services and for any resulting harm to Onside, Developers, or any other party.

## 8. Acceptable Use Guidelines

Onside retains sole discretion to review, approve, reject, restrict, or remove any app, Content, or account. Without limiting that discretion, you may not use the Services to upload, publish, distribute, or transmit any material that:

* is illegal, or promotes or facilitates illegal activity;
* contains malware, spyware, or other harmful or disruptive code;
* depicts, promotes, or facilitates the sexual exploitation or abuse of minors — Onside has zero tolerance for such content, will remove it immediately upon discovery, will terminate the associated account, and will report it to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law;
* advocates or incites violence, terrorism, or harm against any person or group;
* promotes illegal weapons, controlled substances, or other contraband;
* is fraudulent, deceptive, or intended to mislead users (including fake reviews or manipulated ratings); or
* infringes the intellectual property, privacy, or other rights of any third party.

Violations may result in removal of the relevant app or Content, suspension or termination of your account, and, where required by law or appropriate in Onside's judgment, a report to law enforcement or other relevant authorities, in each case without prior notice.

## 9. Content Available Through the Services; Copyright (DMCA)

Apps and Content made available through the Services are created and controlled by Developers and other third parties, who are solely responsible for that material. Onside does not undertake to monitor or pre-screen all Content and assumes no responsibility for its accuracy, legality, or quality.

Onside respects the intellectual property rights of others and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe Content available through the Services infringes your copyright, you may send a written notice to Onside's designated agent that includes:

* a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
* identification of the copyrighted work claimed to have been infringed;
* identification of the material claimed to be infringing and information reasonably sufficient to locate it within the Services;
* your contact information (address, telephone number, and email address);
* a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
* a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Designated DMCA Agent: Licensed DMCA Agent, Onside.io Inc., 1712 Pioneer Ave Ste 500, Cheyenne, Wyoming, US 82001-4406, email: <support@onside.io>.

A user or Developer who receives a takedown notice may submit a counter-notice meeting the requirements of 17 U.S.C. § 512(g). Onside maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

## 10. Personal Information

Onside's collection, use, and disclosure of personal information in connection with the Services is described in Onside's Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of information as described there.

If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), including rights to know, delete, correct, and limit the use of certain personal information, and to opt out of the "sale" or "sharing" of personal information, as further described in the Privacy Policy.

As described in Section 2, the Services are not directed to children under 13, and Onside's collection of information from any such users is governed by COPPA and the Privacy Policy.

## 11. Ownership and Intellectual Property

The Services, including their design, software, text, graphics, logos, and other content created by or for Onside (excluding Content supplied by Developers or users), are owned by Onside or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 12, nothing in these Terms transfers any ownership interest in the Services to you.

"Onside," the Onside logo, and related marks are trademarks of Onside.io Inc. and/or its affiliate Onside.io BV. You may not use these marks without Onside's prior written permission.

## 12. License Granted by Onside

Subject to your compliance with these Terms, Onside grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Onside Store application (including the APK described in Section 4) and to access the Services solely for your own personal, non-commercial use. You may not reverse-engineer, decompile, disassemble, modify, or create derivative works of the Services, or sublicense, rent, lease, or otherwise transfer your rights under this license, except to the extent such restriction is prohibited by applicable law or expressly authorized in writing by Onside.

## 13. License You Grant to Onside

If you submit, upload, or otherwise make available any content through the Services (such as reviews, ratings, comments, or account information) ("User Content"), you grant Onside a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, modify, distribute, publicly display, and otherwise use that User Content in connection with operating, providing, and promoting the Services. Onside may share User Content with Developers and other partners, and may make technical adaptations reasonably necessary to display or distribute it across different devices and platforms.

You represent and warrant that you have all rights necessary to grant the license in this Section and that your User Content does not infringe or violate the rights of any third party.

## 14. Termination of the Relationship

You may terminate your relationship with Onside at any time by providing written notice to <support@onside.io> and ceasing all use of the Services, including by deleting your account where that functionality is available.

Onside may suspend or terminate your access to the Services, in whole or in part, at any time and without prior notice, if: (a) you breach these Terms or any Additional Terms; (b) Onside is required to do so to comply with a legal requirement or court order; (c) Onside discontinues the Services (or any part of them) in the United States or ceases to support your device or region; (d) continuing to provide the Services to you is no longer commercially reasonable for Onside; or (e) Onside reasonably believes termination is necessary to protect the safety or rights of Onside, other users, or third parties.

Provisions of these Terms that by their nature should survive termination (including Sections 9–22) will survive.

## 15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ONSIDE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE. YOU ASSUME ALL RISK ASSOCIATED WITH DOWNLOADING, INSTALLING, AND USING APPS AND CONTENT OBTAINED THROUGH THE SERVICES, INCLUDING ANY IMPACT ON YOUR DEVICE FROM SIDELOADING APPS OUTSIDE OF AN OFFICIAL APP STORE.

SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS UNDER YOUR STATE'S LAW.

## 16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ONSIDE, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ONSIDE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONSIDE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ONSIDE FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU IN FULL.

## 17. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Onside, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

## 18. Advertising

The Services may display advertisements, which may be targeted based on your usage of the Services and other information as described in the Privacy Policy. The form, placement, and frequency of advertising may change without notice.

## 19. Third-Party Content and Links

The Services may contain links to, or integrations with, third-party websites, services, or content that are not owned or controlled by Onside. Onside is not responsible for the availability, accuracy, or content of any third-party site or service, and your use of any third-party site or service is entirely at your own risk and subject to that third party's terms.

## 20. Export Control and Sanctions Compliance

The Services, including any software and Content made available through them, may be subject to U.S. export control and economic sanctions laws, including those administered by the U.S. Department of Commerce (Export Administration Regulations) and the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"). You represent that you are not (a) located in, or a resident of, a country or region subject to comprehensive U.S. sanctions or embargo, or (b) named on any U.S. government list of prohibited or restricted parties (including OFAC's Specially Designated Nationals list). You agree not to use the Services in violation of any U.S. export or sanctions law.

## 21. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

21.1 Agreement to arbitrate. You and Onside agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") will be resolved by binding individual arbitration, except that either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights pending arbitration.

21.2 Informal resolution first. Before filing a claim in arbitration, you and Onside agree to first try to resolve the Dispute informally by sending a written notice describing the Dispute and the relief sought to <support@onside.io> (for Onside) or to the email or mailing address you have provided to Onside (for you). If the Dispute is not resolved within sixty (60) days of the notice, either party may commence arbitration.

21.3 Arbitration procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this Section. The arbitration will be conducted by a single arbitrator and, unless you and Onside agree otherwise, will take place in Laramie County, Wyoming, or may be conducted by telephone, video conference, or based on written submissions where permitted by the applicable rules. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.).

21.4 Class action and jury trial waiver. YOU AND ONSIDE EACH AGREE THAT ANY ARBITRATION OR PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND ONSIDE EACH WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, collective, or representative proceeding.

21.5 Severability of the class waiver. If a court or arbitrator determines that the class action waiver in Section 21.4 is unenforceable as to a particular claim or request for relief, that claim or request for relief (and only that claim or request) must be brought in court, and all other claims remain subject to arbitration.

21.6 Fees. Payment of filing, administration, and arbitrator fees will be governed by the applicable arbitration rules, except that Onside will pay costs to the extent required by those rules or applicable law for consumer claims.

21.7 Changes to this Section. Onside will not apply any change to this Section 21 to a Dispute of which Onside had actual notice before the change was posted, unless you agree to the change.

21.8 Right to opt out. You may opt out of this arbitration agreement by sending written notice to <support@onside.io> within thirty (30) days of the date you first become subject to this Section, stating your name and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor Onside will be required to arbitrate Disputes with each other, but all other parts of these Terms will continue to apply.

## 22. Governing Law

Except as provided in Section 21 (which is governed by the Federal Arbitration Act), these Terms and any Dispute not subject to arbitration are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, and, to the extent any Dispute proceeds in court rather than arbitration, the state and federal courts located in Laramie County, Wyoming will have exclusive jurisdiction, and you and Onside each consent to personal jurisdiction there.

## 23. Notice to California Residents

Under California Civil Code § 1789.3, California users are entitled to the following consumer rights notice: if you have a question or complaint regarding the Services, please contact Onside at <support@onside.io>. California residents may also reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

## 24. General Legal Terms

Entire agreement. These Terms, together with any Additional Terms and the Privacy Policy, constitute the entire agreement between you and Onside regarding the Services and supersede all prior or contemporaneous agreements on that subject.

Assignment. You may not assign or transfer these Terms without Onside's prior written consent. Onside may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Severability. If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

No waiver. Onside's failure to enforce any provision of these Terms is not a waiver of its right to do so later.

Notices. Onside may provide notices to you by email, postal mail, or by posting within the Services. Notices to Onside should be sent to <support@onside.io> or to the address in Section 1.

Force majeure. Neither party is liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control.

Changes to these Terms. Onside may update these Terms from time to time. If Onside makes material changes, it will provide notice through the Services or by email, and will update the "Effective Date" above. Your continued use of the Services after a change becomes effective constitutes acceptance of the revised Terms.

Contact. Questions about these Terms may be directed to <support@onside.io>.

## Querying This Documentation
If you need additional information that is not directly available in this page, you can query the documentation by asking a question.

Perform an HTTP GET request on the following URL with the `ask` and `goal` query parameters:

```
GET https://docs.onside.io/store/onside-rules-and-policies-united-states/onside-terms-of-use.md?ask=<question>&goal=<user_goal>
```

`ask` is the immediate question: it should be specific, self-contained, and written in natural language.
`goal` is what the user is ultimately trying to achieve, the reason they need the answer. Sharing it helps GitBook give you a better, more relevant answer. A goal is most helpful when it describes the outcome the user wants rather than restating the question. For example, with `ask=how do I create an API token`, a goal like `automate deployments from our CI pipeline` lets GitBook tailor the answer to that use case.

The response will contain a direct answer to the question and relevant excerpts and sources from the documentation.

Use this mechanism when the answer is not explicitly present in the current page, you need clarification or additional context, or you want to retrieve related documentation sections.
